If You Don’t Have a Plan, the State Has One for You

Understanding Wills

While trust-based plans are appropriate for the vast majority of my clients, will-based plans are sometimes the right solution.  I do not take a “one size fits all” approach and if a will is what you need, a will is what I will recommend.  Generally, a will ultimately ends up in probate, but that is not always the case.  When used in conjunction with appropriate “payable on death” beneficiaries or other non-probate means of transferring ownership of property/assets, it can be effective.  There are some pitfalls to these planning mechanisms, however, that we should discuss before you decide that this is how you would like to proceed.

Also, a will (unlike a trust) is only effective upon your death.  As such, it is critical to do other incapacity planning as well, such as ensuring you have up-to-date General Durable Power of Attorney and Advanced Directive for Healthcare documents prepared.  I provide these documents for my clients as part of any estate-planning package.

Even if I am designing a trust based plan for you, you will also need what is called a Pour Over Will to address certain issues that must be addressed through a will, rather than a trust, such as guardianship of minor children, or what should happen to any assets that do not get properly funded into your trust. As such, every single estate plan needs a will of some kind in it.

State law decides who inherits your property, which may not match your wishes. A valid will ensures your loved ones receive what you intend.

You should review it every few years or whenever a major life event occurs—like marriage, divorce, a new child, or acquiring property.

Technically? Yes. “Do it Yourself” wills, however, are often replete with legal and technical problems that end up costing families much more when probate is necessary. Having an attorney design your estate plan may be most expensive on the front end, but it (more often than not) will save your loved ones a lot of time, heartache, and money when you pass away.
