Understanding Special Needs Trusts

Planning for the future of a child or adult with disabilities can feel overwhelming.  As the parent of a child with disabilities, myself, I felt paralyzed about my own estate planning for a long time –  until I got the advice of a trusted attorney.  And then, I found peace of mind.

If you are a disabled individual and are coming into some assets, whether through inheritance or a legal settlement of some kind, without proper planning, you can become ineligible for the essential services you depend upon, like SSI and Medicaid.

A properly structured Special Needs Trust is the answer to many family’s and individual’s needs when it comes to disability planning. I guide families through two key types of trusts:

  1. Third-Party Trusts: Created and funded by family members or others (like parents or grandparents) to provide for a loved one without jeopardizing their public benefits.

  2. First-Party (or “Self-Settled”) Trusts: Established for individuals with disabilities using their own assets—such as an inheritance or legal settlement —to preserve crucial eligibility for government assistance.
