Probate is handled through Douglas County Circuit Court. It involves validating the will (if there is one), identifying and paying debts, and distributing remaining assets to beneficiaries. Smaller estates may qualify for a more streamlined process called a Simple Estate Affidavit.

A Special Needs Trust lets you provide for your disabled child (even if that child is an adult) without affecting their government benefits. I can also help with guardianship or conservatorship if needed.

No. Most of my Roseburg clients work with me by phone or video for the majority of the work we do, and then I will travel to you for the document signing.

Most people need a trust and/or will, a general durable power of attorney, and an advance healthcare directive. I’ll help you figure out exactly what’s right for your situation.

A will only takes effect after you pass away and, generally, still requires a person’s estate to go through the probate process. A trust is effective immediately so that it can help protect you during your lifetime if you become incapacitated, and if properly funded, can avoid probate entirely.

Oregon law decides who gets your assets, which may not align with your wishes or values. It can also make things harder and more expensive for your family.

With me, depending on scheduling, the process usually takes 4-6 weeks from start to finish (although in an emergency, I have been able to get will-based plans done in a couple of hours and trust-based plans done in a matter of a few days). It involves an initial consultation to determine what kind of overall plan best suits your needs (a will or a trust-based plan). From there, I will ask you to provide me some general information about your assets and the people who are important in your life. Once I get that information from you, we will have a design meeting in which I ask you a bunch of questions to make sure I understand your unique desires and goals, and then I can set about drafting the documents to implement the plan we have designed together. We can then schedule a signing meeting.
